Spousal Open Work Permit

Any individual holding a temporary resident visa in Canada can invite his / her spouse to work in Canada. It allows spouses and common-law partners to work in Canada. If your spouse is currently on a study permit or work permit, you may automatically qualify for an Open Spousal Work Permit.

Spouse or Common-Law Partner is currently residing outside of Canada:
  • Either spouse or partner can apply to enter Canada as a visitor. If the application is approved, the spouse or partner can enter Canada as a visitor. Once in Canada as a visitor, the spouse or partner can apply for an open work permit online or by paper through the IRCC office inside of Canada. If the application is approved, an open work permit is issued, and the spouse/partner can work in Canada.
  • Spouse or partner can apply for an open work permit at a visa office outside of Canada. If the application is approved, the spouse/partner will be issued a Letter of Introduction for a Work Permit and be issued a Temporary Resident Visa or Electronic Travel Authorization (if required). Spouse or partner can enter Canada and can begin working.
 
Spouse or Common-Law Partner is currently residing in Canada:
  • If the spouse or partner has valid status as a visitor in Canada, they can apply for an open work permit online or by paper through the IRCC office in Canada. If the application is approved, an open work permit will be issued, and the spouse or partner can begin working.
 

Eligibility Criteria

Client may be eligible for an open work permit if you are:

  • Spouse of a skilled worker in an occupation under the National Occupational Classification (NOC) skill type 0, A or B approved to work in Canada six months or longer.
  • Spouse of someone applying for the Atlantic Immigration Pilot Program in a job under NOC 0, A, B or C.
  • Spouse of a foreign student at a public post-secondary school, such as a college or university or collège d’enseignement général et professionnel (CEGEP) in Quebec.
    • Family member of a foreign representative.
    • Family member of a foreign military member who is working in Canada.
  • If client’s spouse has an open work permit (e.g., post-graduation work permit), they must attach a copy of their spouse’s work permit to the application for an open work permit, along with:
  • A letter from their spouse’s current employer that confirms they work there in a NOC 0, A or B occupation, or a copy of your spouse’s employment offer or contract, and
  • A copy of their spouse’s recent pay slips
